"Only marriage between one man and one woman shall be recognized as valid in this state. No other relationship shall be recognized as a marriage or its legal equivalent by the state, its political subdivisions, or educational institutions under Article VII, regardless of whether such relationship is recognized by the laws of any jurisdiction outside of this state."

Inasmuch as marriage is the legal union of only one man and one woman as husband and wife, no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized"

An amendment to the state constitution approved by voters in 2004 to define marriage as the union of one man and one woman also prohibits public employers from providing health care and other benefits to the same sex partners of employees, a divided Michigan Supreme Court ruled today.
The court majority found that language in the amendment prohibiting recognition of other unions "for any purpose" included the extension of benefits to gay and lesbian partners of public employees. Several Michigan universities, including U-M and MSU, along with various municipal and school employers had offered the benefits as a means of attracting workers.

"Dissenting Justices Michael Cavanagh and Marilyn Kelly ....argued that circumstances surrounding the election suggest Michigan voters didn't intent to take away people's benefits."

"The couples represented by the American Civil Liberties Union of Michigan argued the ballot committee that sponsored Proposal 2 "consistently and repeatedly" assured voters that the initiative was only about protecting marriage." (Just like they're promising in Florida right now)

?This is a flawed and unfortunate decision. The majority opinion ignored the multiple statements made during the ballot initiative campaign by its supporters that they did not intend to take away health care from families and children," said Kary L. Moss, ACLU of Michigan Executive Director.
